White House Accuses Moonshot AI of Distilling Anthropic Model

Michael Kratsios, director of the White House Office of Science and Technology Policy, wrote on X that Chinese firm Moonshot AI developed an internal platform to distill U.S. models at scale and used methods intended to avoid detection. The post names Anthropic’s Fable model as the source of the alleged extraction and links that activity to the launch of Kimi K3.

Kratsios contrasted ordinary research distillation, which creates smaller or more efficient versions of models, with what he described as large-scale covert distillation aimed at appropriating proprietary U.S. technology. He wrote that the latter crosses a line and is unacceptable.

The timeline cited by U.S. officials centers on Anthropic’s Fable 5, which was taken offline under U.S. export controls and returned to public access on July 1. Moonshot’s Kimi K3 launched on July 16, a 15-day interval the White House says is consistent with industrial-scale distillation. The OSTP post did not provide technical details or public forensic evidence describing how the extraction would have occurred.

Some AI researchers questioned whether distillation alone could explain Kimi K3’s capabilities. Elie Bakouch, a researcher at Prime Intellect, observed the 15-day gap between Fable 5’s re-release and Kimi K3’s debut and expressed doubt that distillation could produce the reported performance in that time. Dean Ball, head of strategic futures at OpenAI, also indicated he did not believe the model’s performance could be accounted for by distillation.

Treasury Secretary Scott Bessent warned that if covert, industrial-scale distillation crosses into intellectual property theft, the United States could impose sanctions or add firms to the Entity List. He said open-source licensing does not permit taking U.S. intellectual property without consequence.

The OSTP post and statements from U.S. officials did not say whether formal investigations or enforcement actions have begun against Moonshot AI. Moonshot had not publicly responded to the specific allegation in the OSTP post. Researchers and officials continue to discuss whether Kimi K3’s development can be traced to distillation from Fable 5 or to other development methods.
