Late-2026 court dates set in three crypto cases

Federal prosecutors in the Southern District of New York proposed an Oct. 20, 2026 final pretrial conference for Tornado Cash co-founder Roman Storm. The schedule would place a potential retrial in late October or November 2026. Storm was convicted in 2025 on one count of illegal money transmission, while jurors deadlocked on two other counts. The timing depends on the court’s resolution of a Rule 29 motion Storm filed seeking acquittal of the remaining charges.
The U.S. Attorney’s Office filing identified the remaining counts as conspiracy to commit money laundering and conspiracy to violate sanctions. Storm is a co-founder and developer of the Tornado Cash protocol, which prosecutors say was used to obscure the origin of cryptocurrency transactions.
In a separate SDNY matter, Judge John Koeltl gave prosecutors 60 days to respond to former Celsius CEO Alex Mashinsky’s pro se motion to vacate his 12-year sentence. Mashinsky began serving that sentence after his May 2025 sentencing. He and Roni Cohen-Pavon were indicted in 2023 on charges tied to fraud and market manipulation related to Celsius’s 2022 bankruptcy. Mashinsky was ordered to pay $48 million in forfeiture; Cohen-Pavon received time served and financial penalties.
Judge Margaret Garnett set a December 2026 trial timeline for Gannon Ken Van Dyke, a U.S. soldier charged with using nonpublic information to profit on a Polymarket event contract tied to the removal of Venezuelan President Nicolás Maduro. The court ordered pretrial motions ahead of jury selection scheduled for Dec. 7, 2026. Prosecutors allege Van Dyke earned more than $400,000; he has pleaded not guilty.
