The Senate is scheduled to leave for recess after Friday and the chamber’s calendar shows no formal vote set for the bill. Senate Majority Leader John Thune controls the floor schedule and is planning to set a vote before Saturday.

The CLARITY Act passed the House in July 2025 by a 294-134 margin. The bill outlines market-structure rules for digital assets, with provisions on stablecoins, tokenized equities and ethics language that has split lawmakers and industry groups.

Advancing the bill in the Senate requires cloture, which needs at least 60 votes to end debate and overcome a filibuster. Several Senate Democrats are seeking stronger ethics conditions tied to the legislation, pointing to disclosures showing President Donald Trump earned more than $1.4 billion in 2025 from investments connected to digital assets.

At least one Republican, Sen. Josh Hawley, has said he will withhold his vote until the bill addresses concerns raised by banks. Lawmakers reached a compromise with banking groups on stablecoin yield provisions, while some industry leaders continue to press for rules that would impose bank-like licensing and restrictions on crypto firms.

With only a few business days before the recess, negotiators face a narrow window to resolve outstanding disputes. If the Senate does not complete action before the break, consideration of the CLARITY Act would likely resume when the chamber reconvenes in mid-September, moving debate into the run-up to the 2026 midterm elections.
