The law targets “algorithmic discrimination” and covers uses of AI in employment, housing and finance. It is intended to protect residents from biased outputs in those areas.
According to the complaint, “Colorado cannot alter xAI’s message simply because it wants to amplify its own views on the highly politicized subjects of fairness and equity.” The filing also describes the statute as promoting “differential treatment” to “increase diversity or redress historical discrimination” and contends that changing Grok’s responses would undermine its goal of being “maximally truth seeking.”
xAI asks the court for an order blocking enforcement, asserting the measure would chill speech by compelling particular outputs and by imposing conflicting directives on AI systems.
In December, xAI filed a separate case in California challenging the state’s Generative AI Training Data Transparency Act, arguing that disclosure mandates would force speech and risk exposure of trade secrets in violation of the First and Fifth Amendments.
Grok has drawn criticism after accusations that the chatbot generated child abuse images, racist, sexist and antisemitic content. xAI maintains that state content rules would interfere with how its models generate answers and with its design choices.
The Colorado complaint was filed in the U.S. District Court in Colorado and seeks to block enforcement of SB 24-205 on constitutional grounds.
