Elon Musk's AI company xAI filed a lawsuit against OpenAI on September 25, alleging the rival firm stole proprietary data by hiring away key employees who allegedly breached confidentiality contracts.
xAI claims OpenAI engaged in a "strategic campaign" to recruit personnel with knowledge of xAI's core systems and then induced them to misappropriate trade secrets related to its Grok chatbot and infrastructure.

The suit, filed in California federal court, names former engineers and a senior finance executive as part of the alleged misconduct. According to xAI, OpenAI's hiring practices targeted employees to extract sensitive internal information rather than simply attract talent.

The complaint cites internal documents, recruiting behavior, and a pattern of resignations as evidence of coordinated action. xAI specifically mentions former engineer Xuechen Li, who allegedly copied confidential data before joining OpenAI and selling $7 million in xAI stock.

A court granted a temporary order blocking Li from discussing or working on generative AI at OpenAI until the dispute is resolved. OpenAI denied the claims and called the filing the latest stage of Musk's ongoing harassment campaign. The company has not provided detailed responses to the specific allegations.

The complaint asserts that OpenAI targeted employees with specialized knowledge, including Grok's source code, data center operations, and business plans. xAI accuses OpenAI of inducing "those employees to breach their confidentiality obligations."
The lawsuit intensifies a long-running conflict between Musk and OpenAI. Musk, a co-founder of OpenAI, has frequently criticized its pivot to a profit model and its partnerships, particularly with Microsoft. Separately, xAI sued Apple, accusing it of colluding with OpenAI to suppress competition in the AI space.

The parties are scheduled to return to court in early October to determine whether the restraining order against Li should be extended. The broader lawsuit seeks damages and injunctive relief to prevent further alleged trade secret theft.
